David’s main areas of practice are insurance defense, commercial and complex litigation, trucking and transportation, general litigation, workers’ compensation, and governmental entities. He has handled many cases involving premises liability, wrongful death, motor vehicle, and trucking defense. David is a frequent speaker with the National Business Institute related to UM/UIM law.
David is the managing shareholder of Hill, Hill, Carter, Franco, Cole and Black, one of Montgomery’s oldest civil defense firms. He has practiced law for over 23 years and devotes 95% of his practice to insurance defense, defending insureds and insurance companies throughout the state of Alabama in extra-contractual litigation, bad faith, fraud and claims defense. Mr. Henderson has litigated cases in 62 of the 67 counties in Alabama and practices in all Federal courts throughout the state.
While attending college at Faulkner University he joined the United States Marine Corps Reserve where he served as Sergeant and section chief for a 155mm Howitzer Cannon Section.
After graduating with a criminal justice degree, he attended Jones School of Law and received his juris doctorate.
He began work at Hill, Hill, Carter as a runner while in college and worked his way up to Office Administrator, law clerk, associate attorney and became managing shareholder in 2008 at the age of 33, one of the youngest managing shareholders of a mid-sized firm in the state and has served in that capacity ever since. Since that time, the Firm has grown to become a majority female owned firm with offices in Montgomery, Birmingham, Fairhope and Louisville, Kentucky.
Mr. Henderson is a member of the Alabama State Bar Association, Montgomery County Bar Association, Alabama Defense Lawyers Association, Defense Research Institute and International Association of Defense Counsel.
David is married and has two children. He enjoys running, biking as well as hunting and working on his cattle farm.
Obtained a defense verdict in a clear liability rear-end automobile accident where the plaintiff had medical damages in excess of $30,000.00.
Successful appeal to the Alabama Supreme Court that reversed an Alabama trial courts default judgment in the amount of $120,000.00.
Awarded summary judgment in a fraud case where the plaintiff argued his insurer and agent miscalculated his homeowners insurance premiums on two properties for almost 20 years.
Awarded summary judgment in wrongful death automobile accident on basis of Alabama Guest Statute as it related to plaintiff’s negligence and gross negligence claims.
Obtained a defense verdict in a clear liability T-bone automobile accident.
