Attorney Jesse K. Anderson recently won a jury trial, receiving a defense verdict. The case concerned a mobile home fire that occurred in Elmore County, Alabama. The Plaintiff suffered bodily injury and property damage as a result of the fire. The Plaintiff alleged that the fire was caused by a malfunction and/or dangerous condition with the natural gas oven within the mobile home. Jesse’s client (the Defendant) was the Plaintiff’s landlord and owner of the mobile home. The Plaintiff alleged that the Defendant was aware of this malfunction and/or dangerous condition, and was negligent by refusing or failing to repair the oven. At trial, the defense was able to prove that such a malfunction and/or dangerous condition did not exist, and that the fire was likely caused by the Plaintiff’s own negligence.
